of it will be his own, and the other half their own for use only
during the last year.
The Defendant Salameh admitted that this land on which the well
is situated is the property of his father and he therefore took pos-
session of the well together with his father. Suliman the a/m.
claimed that this land was his own, through inheritance from
his father according to Registration Certificate dated 1st of February 310
No 277, containing an area of 3 dunams and registered as Ard Khallet-
Mazhar and bounded:

        South   Kharab
        East    Abdallah Nassar
        North   Plain land.
        West    Ard Dein Ballout.

Since it appeared that the submitted Certificate of Registration
concerned a different piece of land than that claimed by the Plain-
tiff, and that it differed from the land in dispute in many respects,
as shown in the Certificates of Registration and the Report of the
Commission of Inspection, and as the Court is convinced of the
encroaching of the Defendants upon the land in dispute and
the well therein since last year only, while the Plaintiff was in
possession of same since long ago and his father possessed it before
him and since it appeared from the letter of the Registrar of Lands Na[blus]
dated 1/2/34 No 85/929-26 that the Certificate produced by the
Plaintiff is still valid and in accordance with Official Registers., and
as this land was not registered in the name of the Govermt. as
stated by some witnesses, and as even the witnesses of the
Defendants certified that the Defendant Selman never was
in possession of the land and well therein except during the
past year:

    For these reasons and in accordance with Article 24 of
Magistrates Law, and Article 1818 of the Majalla it was decided
to evict the possession of the Defendants upon the
well in question situated in Ard Jouenet Ka'el Dar,
mentioned above, and its restoration to the Plaintiff
